Council doesn't need new legal theories to end the Flock contract: it needs one action the contract already provides: a written notice of non-renewal, sent before September 13, 2026. This draft resolution puts that action in the standard form councils adopt. Any council member can place it on an agenda. Any resident can hand it to one.

RESOLUTION NO. ____

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS, DIRECTING WRITTEN NOTICE OF NON-RENEWAL OF THE CITY'S AGREEMENT WITH FLOCK GROUP INC. PRIOR TO SEPTEMBER 13, 2026; AND PROVIDING FOR RELATED MATTERS.

WHEREAS, the City of Wylie entered into an agreement with Flock Group Inc. ("Flock Safety") for automated license plate reader ("ALPR") services, the current term of which runs from October 14, 2025 through October 13, 2026; and

WHEREAS, under the agreement's own terms, the agreement "will automatically renew for successive renewal terms" (a renewal term of twenty-four (24) months) "unless either Party gives the other Party notice of non-renewal at least thirty (30) days prior to the end of the then-current term," making September 13, 2026 the final date on which the City may decline renewal without cost; and

WHEREAS, the original agreement was approved on the consent agenda without individual discussion, was procured through a sole-source process without competitive bidding, and was funded from seized-asset funds outside the ordinary budget process, such that Wylie residents had no meaningful opportunity for public input; and

WHEREAS, records released pursuant to the Texas Public Information Act, following a ruling of the Texas Attorney General (OR2026-016393), document that data captured by Wylie's cameras is searchable by outside law enforcement agencies nationwide without a warrant, without a Wylie case number, and without notification to the Wylie Police Department; and

WHEREAS, independent evaluations of ALPR systems (including the Los Angeles Police Department Office of Inspector General's July 2026 audit finding approximately one in three hot-list alerts to be false, and peer-reviewed research finding no reduction in violent crime from a comprehensive ALPR deployment) do not establish a public-safety benefit commensurate with the system's documented risks; and

WHEREAS, jurisdictions across Texas, including Hays, Guadalupe, and Hood Counties and the Cities of Austin, San Marcos, Bandera, and Lago Vista, and more than one hundred communities across the nation, including the City of Los Angeles, have terminated, declined to renew, or deactivated equivalent agreements; and

WHEREAS, declining renewal preserves all of the City's future options, including the adoption of a camera program through competitive bidding, public hearing, and a warrant requirement for searches, should the Council later find such a program justified;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS:

SECTION 1. The City Manager is directed to transmit to Flock Group Inc., no later than September 12, 2026, written notice of non-renewal of the agreement in accordance with its terms, such that the agreement expires on October 13, 2026.

SECTION 2. The City Manager is directed to confirm delivery of the notice in writing and to report such confirmation to the Council at its next regular meeting.

SECTION 3. Prior to any future procurement of automated license plate reader or similar surveillance technology, the Council shall (a) hold a noticed public hearing; (b) utilize competitive procurement; and (c) require, as a condition of any contract, that searches of data collected in the City of Wylie be supported by a warrant or recognized warrant exception.

SECTION 4. This Resolution shall take effect immediately upon its passage.
